أثر عدول القضاء الدستوري عن سوابقه على الأمن القضائي

تعتبر أحاكم القضائي الدستوري ملزمة لجميع سلطات الدولة إلا أن بعض تلك الأحكام قد يشوبها الخطأ، أو القصور عن مواكبة التطور في المجتمع من النواحي السياسية والاقتصادية والاجتماعية، مما قد يدفع القاضي الدستوري في حالات وظروف وأزمنة مختلفة إلى العدول عن حكمه السابق لتصحيح الخاطئ من الاحكام والاستجابة للتطورات الجديدة والظروف الاستثنائية، إلا أن ذلك يهدد الأمن القضائي في الدولة مما يدفع ضرورة تحقيق الموازنة بين العدول عن الأحكام القضائية الدستورية وفكرة الأمن القضائي حتى تتحقق الموائمة بين قابلية الحياة القانونية للتطور والتغيير من ناحية، وحق الأفراد في ضمان الثبات والاستقرار النسبي لمراكزهم القانونية.

Which may prompt the constitutional judge in different cases and times to reverse his previous ruling to correct the wrong rulings and respond to new developments and exceptional circumstances. However, this threatens the judicial security of the state, which prompts the need to achieve a balance between overruling and the idea of judicial security to achieve compatibility between the ability of legal life to develop and change on the one hand, and the right of individuals to ensure stability and relative stability of their legal positions.
