يعد نظام المشاركة بين القطاعين العام والخاص أحد الآليات الحديثة التي اتجهت إليها الدول لإنشاء المشروعات العامة بتمويل من القطاع الخاص الخاص ويقوم نظام المشاركة على أنه عقد بين طرفين أحدهما من القطاع العام والآخر من القطاع الخاص ومحلة إنشاء مشروع عام خدمي ذو فائدة لكافة الجماهير.

لذلك نبحث نظام المشاركة بين القطاعين العام والخاص من خلال فصلين: الأول : التعريف بعقود المشاركة بين القطاع العام والقطاع الخاص. والثاني: التكييف القانوني لعقود المشاركة بين القطاع العام والقطاع الخاص.

The partnership system between the public and private sectors is one of the modern mechanisms that countries have turned to to establish public projects with funding from the private sector. The partnership system is based on a contract between two parties, one from the public sector and the other from the private sector, and the purpose of creating a public service project that is beneficial to all audiences.

Therefore, we examine the partnership system between the public and private sectors through two chapters: The first: Definition of partnership contracts between the public sector and the private sector. The second: Legal adaptation of partnership contracts between the public sector and the private sector.
